Tastytalescooking.com cares about the privacy of its visitors and users (collectively, “users,” “you,” or “your”). To that end, this Tasty Tales Cooking Privacy Policy (“Privacy Policy”) describes how Tasty Tales Cooking, LLC (“Tasty Tales Cooking,” “Company,” “we,” “us,” “our,” or “ourselves”) collects, uses, discloses, and otherwise processes your Personal Information when you visit or make a purchase from www.tastytalescooking.com (the “Site”).

1. The Type of Personal Information We Collect

Personal Information” includes Device Identifiers, User Identifiers, and Transactional Information.

Devise Identifiers. When you visit the Site, we automatically collect certain information about your device. This includes the Internet Protocol (IP) address used to connect your computer to the Internet, your web browser, your time zone, time and date of access, and some of the cookies that are installed on your device (“Device Identifiers”). Additionally, as you browse the Site, we collect information about how you interact with the Site, including the individual web pages or products you view and what websites or search terms referred you to the Site.

User Identifiers. When you visit the Site, we may collect user identifiers, including your full name, password, mailing address, phone number, email address, date of birth, and contact preferences, including any other usage and interaction details (“User Identifiers”). We collect additional Personal information that you may provide us, for example, when you subscribe to our Services. We may also collect such information which, when combined with other pieces of information available to us, could reasonably allow you to be identified.

Transactional Information. Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information about the transaction, including your name, billing address, shipping address, email address, phone number, and payment information. “Payment Information” includes the payment card used, PayPal information, Amazon information, the name associated with the payment card, signatures, initials, birthdate, date and time of the transaction, transaction amount, and information about the goods or services purchased in the transaction (“Transactional Information”).

2. How We Collect Personal Information

We collect Personal Information using the following technologies and other similar technologies:

Cookies. A Cookie is a small file of letters and numbers that downloads on your computer when you visit a website. Cookies can be “Persistent” or “Session” Cookies. Session Cookies are deleted as soon as you close your web browser, while Persistent Cookies remain on your personal computer or mobile device when you go offline. You can instruct your browser to refuse all Cookies or indicate when a Cookie is being sent. Unless you have adjusted your browser setting so that it will refuse Cookies, our Service may collect Cookies.

Web Beacons. Certain portions of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to record information about how you browse the Site. For example, to count users who have visited certain web pages or opened an email and other related website statistics.

Log Files. A Log File is a computer-generated data file that contains information about usage, patterns, activities, and operations within an operating system, application, server, or another device. Log Files track actions occurring on the Site and collect data, including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

 

3. How We Use Personal Information Collected

We may collect, use, or process Personal Information for purposes described below:

• To develop and improve the Services and the Site’s content in order to personalize and enhance your experience.

4. Disclosure of Information Collected

Wix. We share your Personal Information with trusted third-party service providers who facilitate the use of your Personal Information, as described above. For example, we use Wix to power our online store, which allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases, and the general Wix.com applications. It stores your data on secure servers behind a firewall. Secure Payments. All direct payment gateways offered by Wix.com and used by our Company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Google. We also use Google Analytics to help us understand how our customers use the Site. Required by Law. Business Acquisition. Finally, we may sell or transfer some or all of our business or assets, including your personal data, in connection with a business transaction (or potential business transaction) such as a merger, consolidation, acquisition, reorganization, or sale of assets or in the event of bankruptcy, in which case we will make reasonable efforts to require the recipient to honor this Privacy Policy.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

 

7. Retention of Information

We will retain your information and any data for the period necessary to fulfill the purposes outlined in this Privacy Policy and for our records unless and until you ask us to delete this information.

This section provides additional details about the Personal Information we collect, and the rights afforded to California and Virginia residents under the California Consumer Privacy Act (“CCPA”) and the Virginia Consumer Data Protection Act (“VCDPA”), respectively. Depending on the state in which you are a resident, you may have the right to:

• Confirm whether Tasty Tales Cooking processes your Personal Information;

• Request details (in a readily usable format) about the categories and specific elements of Personal Information and Sensitive Personal Information we collect, the sources where the information was collected, the purpose for collecting and/or selling Personal Information, the categories of third parties with whom we share Personal Information, and what information we sell or disclose;

You can request that we disclose to you the categories and specific Personal Information (1) we have collected about you, (2) the sources of that Personal Information, (3) the purposes for which we use that Information, (4) the third parties with whom we disclose Personal Information, and (5) the Information that we sell or disclose to those third parties.

For California residents, the following list reflects categories of Personal Information Tasty Tales Cooking may collect or may have been collected in the past twelve (12) months. Please note that the categories and examples provided in the list below are those defined in the CCPA. This does not mean that all examples of that category of Personal Information were, in fact, collected by us but reflects our good faith belief, to the best of our knowledge, that some of that information from the applicable category may be, and may have been, collected. For example, certain categories of Personal Information would only be collected if you provided such Personal Information directly to us.

• Category A: Identifiers. Examples: A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, driver’s license number, passport number, or other similar identifiers. Collected: Yes. •

Category B: Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). Examples: A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Some Personal  Information included in this category may overlap with different categories. Collected: Yes.

• Category C: Protected classification characteristics under California or federal law. Examples: Age, race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth, and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information). Collected: No.

• Category D: Commercial information. Examples: Records and history of products or services purchased or considered. Collected: Yes.

• Category E: Biometric information. Examples: Genetic, physiological, behavioral, and biological characteristics or activity patterns used to extract a template or other identifier or identifying information, such as fingerprints, faceprints, voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data. Collected: No.

• Category F: Internet or other similar network activity. Examples: Interaction with our Service or advertisement. Collected: Yes.

• Category G: Geolocation data. Examples: Approximate physical location. Collected: Yes.

• Category H: Sensory data. Examples: Audio, electronic, visual, thermal, olfactory, or similar information. Collected: No.

• Category I: Professional or employment-related information. Examples: Current or past job history or performance evaluations. Collected: No.

• Category J: Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)). Examples: Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records. Collected: No.

• Category K: Inferences drawn from other Personal Information. Examples: Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. Collected: No.

Please note, under CCPA, Personal Information does not include:

• Publicly available information from government records.

• De-identified or aggregated consumer information.

• Information excluded from the CCPA’s scope, such as health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data.

• Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

 

8.2 CCPA Disclosure of Personal Information for “Business Purposes” or “Commercial Purposes”

We may use or disclose Personal Information we collect for “business purposes” or “commercial purposes” (as defined under the CCPA) and may have used or disclosed in the last twelve (12) months the following categories of Personal Information for business or commercial purposes:

• Category A: Identifiers.

• Category B: Personal Information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

• Category D: Commercial information.

• Category F: Internet or other similar network activity.

Please note that the categories listed above are those defined in the CCPA. This does not mean that all examples of that category of Personal Information were, in fact, disclosed but reflects our good faith belief, to the best of our knowledge, that some of that information from the applicable category may be, and may have been, disclosed.

When we disclose Personal Information for a business purpose or a commercial purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

 

8.3 CCPA Sale of Personal Information

As defined in the CCPA, “sell” and “sale” mean selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means a consumer’s personal information by the business to a third party for valuable consideration. This means that we may have received some kind of benefit in return for sharing Personal Information, but not necessarily a monetary benefit.

Please note that the categories listed below are those defined in the CCPA. This does not mean that all examples of that category of Personal Information were, in fact, sold, but it reflects our good faith belief, to the best of our knowledge, that some of that information from the applicable category may be, and may have been, shared for value in return.

We may “sell” and may have “sold” in the last twelve (12) months the following categories of Personal Information:

• Category A: Identifiers.

• Category B: Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

• Category D: Commercial information.

• Category F: Internet or other similar network activity.

 

8.4 CCPA Right to Say No to the Sale of Personal Data (Opt-Out)

We do not “sell” information about you to third parties in the traditional sense. However, in order to help Tasty Tales Cooking deliver advertising and marketing on other platforms, we do allow third parties to collect information through our Services.

You have the right to direct us not to sell your Personal Information. To submit an opt-out request, please get in touch with us at info@tastytalescooking.com. We may verify the request by asking you to provide information that matches the information we have on file about you. A request may also be made on behalf of your child under 13. Further, California residents can empower a designated authorized agent to exercise these rights on your behalf. However, we will require proof that the person is authorized to act on your behalf and may also still ask you to verify your identity with us directly.

If you are a Virginia resident and Tasty Tales Cooking is unable to satisfy your request to exercise a right available to you under the VCDPA, you are entitled to appeal our decision by emailing info@tastytalescooking.com.

 

8.5 CCPA Right to Limit Use and Disclosure of Sensitive Personal Information

Consumers also have the right to limit a business’s use and disclosure of their Sensitive Personal Information. Sensitive Personal Information is a specific subset of Personal Information that includes certain government identifiers, including social security numbers, financial accounts, debit card, or credit card numbers with any required security code, password, or credentials allowing access to an account; precise geolocation; contents of mail, email, and text messages; genetic data; biometric information processed to identify a consumer; information concerning a consumer’s health, sex life, or sexual orientation; or information about racial or ethnic origin, religious or philosophical beliefs, or union membership. You can direct us to only use your Sensitive Personal Information for limited purposes, including providing you with the Services you requested. 8.6 CCPA Targeted Advertising Opt-Out Instructions

You have a right to limit the use of your Personal Information for Targeted Advertising (defined in California as “Sharing”). You can ask us not to use or disclose your Personal Information for targeted advertising. You also can use the Global Privacy Control to signal your opt-out preference.      o Choose “Opt-out of Interest-Based Ads” or “Opt-out of Ads Personalization” on Android devices;

     o Choose “Limit Ad Tracking” on iOS devices;

     o You can stop the collection of location information from your mobile device by changing the preferences on your mobile

       device.

 

8.7 CCPA Right to Delete Personal Information

You have the right to request the deletion of your Personal Information, subject to certain exceptions. To exercise your right, please send your request to info@tastytalescooking.com. Once we receive your request, we may ask for additional information for verification purposes. After we confirm your request, we will delete your Personal Information from our records unless an exception applies. We may deny your deletion request if retaining the information is necessary for us to:

• Complete the transaction for which we collected the Personal Information, to provide goods or services that you requested, to take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

• Debug products to identify and repair errors that impair existing intended functionality.

• Exercise free speech, ensure the right of another consumer to exercise their free speech rights or exercise another right provided for by law.

• Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws when the information’s deletion may likely render impossible or seriously impair the research’s achievement if you previously provided informed consent.

• Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

• Comply with a legal obligation.

• Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

8.8 Minors Under 18 Years of Age

We do not knowingly collect Personal Information from minors under the age of 18 through our Service, although certain third-party websites that we link to may do so. These third-party websites have their own terms of use and privacy policies, and we encourage parents and legal guardians to monitor their children’s Internet usage and instruct their children to never provide information on other websites without their permission.

We do not sell the Personal Information of Consumers we actually know are less than 18 years of age unless we receive affirmative authorization (the “right to opt-in”) from the parent or guardian of a Consumer less than 18 years of age. Consumers who opt into the sale of Personal Information may opt out of future sales at any time. To exercise the right to opt out, you (or your authorized representative) may submit a request to us by contacting us.

California Business and Professions Code Section 22581 allows California residents under the age of 18 who are registered users of online sites, services, or applications to request and obtain removal of content or information they have publicly posted. To request removal of such data, and if you are a California resident, you can contact us using the contact information provided below and include the email address associated with your account. Be aware that your request does not guarantee the complete or comprehensive removal of content or information posted online and that the law may not permit or require removal in certain circumstances.  If you have reason to believe that a child under the age of 18 has provided us with Personal Information, please contact us at info@tastytalescooking.com with sufficient detail to enable us to delete that information.

 

8.9 CCPA Right Not to be Discriminated Against

You have the right not to be discriminated against for exercising any of your consumer’s rights, including by:

• Denying goods or services to you;

• Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties;

• Providing a different level or quality of goods or services to you;

• Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services; and

• Exercising your CCPA Data Protection Rights.

In order to exercise any of your rights under the CCPA, and if you are a California resident, you can contact us by email at info@tastytalescooking.com. Only you or a person registered with the California Secretary of State that you authorize to act on your behalf may make a verifiable request related to your Personal Information. Your request to us must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative and

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with the required information if we cannot verify your identity or authority to make the request and confirm that the Personal Information relates to you. We will disclose and deliver the required information free of charge within 45 days of receiving your verifiable request. The time to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice.

Any disclosures we provide will only cover the 12-month period preceding the verifiable request’s receipt.

For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another without hindrance.

 

8.10 California Privacy Rights Under California’s Shine the Light Law

Under California Civil Code Section 1798 (California’s Shine the Light law), California residents with an established business relationship with us can request information once a year about sharing their Personal Data with third parties for the third parties' direct marketing purposes.

9. Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or the plural.

For the purposes of this Privacy Policy:

Business,” for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers’ Personal Information and determines the purposes and means of the processing of Consumers’ Personal Information or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ Personal Information that does business in the State of California.

Country” refers to the United States.

Device” means any device that can access the Service, such as a computer, a cellphone, or a digital tablet.

Do Not Track” (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing Internet users to control the tracking of their online activities across websites.

Personal Information” is any information that relates to an identified or identifiable individual. For the purposes of the CCPA, Personal Information means any information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with you.

Sale,” for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means a Consumer’s Personal Information to another business or a third party for monetary or other valuable consideration.

Site” refers to all sites owned by or associated with Tasty Tales Cooking, accessible from www.tastytalescooking.com.

Service Provider” means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used.

Visitors to and users of our site our site and/ or purchasers of our products or subscription packages (collectively, “users,” “you,” or “your”) are engaging in our “Services” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those all terms and conditions and policies referenced herein and/or available by hyperlink during Checkout. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

We reserve the right, but are not obligated, to limit the sales of our Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of Services are subject to change at anytime without notice, at the sole discretion of us.  Any offer for any Service is void where prohibited.

We may, without prior notice, change the Services; stop providing the Services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.  

If you object to any changes to the Services, your sole recourse will be to cease using the site and Service, terminate your Subscription for a pro-rata refund of any amounts you have pre-paid for the Subscription (if any), or not renew the Subscription (if applicable).  Continued use of the Services following posting of any such changes will indicate your acknowledgement of such changes and satisfaction with the Services as so modified.  We also reserve the right to discontinue the website and/or Services at any time without notice.  We will not be liable to you or any third-party should we exercise our right to modify or discontinue the site or the Services.

Section 2

HOLD HARMLESS AGREEMENT AND WAIVER

The Tasty Tales Cooking subscription service that I am signing up for involves food preparation and cooking with appliances. Given the common dangers and use of tools and cooking appliances in a kitchen, and of handling raw ingredients, you agree to hold harmless Tasty Tales Cooking, LLC (“Tasty Tales Cooking”) and the Tasty Tales Cooking employees, owners, and authors from any and all liability, loss, claim, demand, action or cause of action which arises or may arise or be occasioned in any way by participation in a Tasty Tales Cooking activity in presence on the property or in my home by you or your minor children. You understand that you are ultimately responsible for maintaining the quality of food you prepare, cook, and eat during any cooking activity.

In consideration of being permitted to purchase and participate in this cooking subscription service, you hereby waive, release, and discharge any and all claims for damages or personal injury, death, or property damage which you or your child, may have or which may hereafter accrue as a result of my participation in a Tasty Tales Cooking activity, except for harm caused intentionally by or due to the gross negligence of the Tasty Tales Cooking's agents. This release is intended to discharge in advance all members of its staff whether contracted or employed from and against any and all liability arising out of or connected in any way with any participation in said activity, except as specified above. You hereby release and forever discharge us from, and hereby waive and relinquish, each and every past, present and future dispute, claim, controversy, demand, right, obligation, liability, action and cause of action of every kind and nature (including personal injuries, death, and property damage), that has arisen or arises directly or indirectly out of, or relates directly or indirectly to, any interactions with, or act or omission of our Services. You agree that in the event you bring a lawsuit against Tasty Tales Cooking, LLC or any of its owners or agents and are unsuccessful, you must reimburse the defendants in that case for any costs or expenses incurred in defending such lawsuit, including reasonable attorney’s fees.

 

BY PURCHASING ANY PRODUCT, SUBSCRIPTION OR SERVICE ON THIS WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS HOLD HARMLESS AGREEMENT, WAIVER, AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS.

Section 3

COMMERCIAL TERMS

Obligations.  When purchasing a subscription or add-on product, you agree that: (i) you are responsible for reading the full item description before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase when you commit to buy and you complete the check-out payment process.

When you make an order, you are making an offer to purchase, and such offer is subject to our acceptance.  Your receipt of an order confirmation from us does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to refuse any order (in whole or in part) you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We may require additional verifications or information before accepting any order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.   Notwithstanding the foregoing, you agree that, if we cancel all or a part of your order, your sole and exclusive remedy is either that (a) we will issue a credit to your credit card or payment account in the amount charged for the cancelled portion (if your credit card has already been charged for the order) or (b) we will not charge your credit card or payment for the cancelled portion of the order.

Accounts.  You agree to provide true, current, complete and accurate purchase and account information for all purchases made on our site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.  You represent and warrant that: (a) all required registration information you submit is truthful and accurate; and (b) you will maintain the accuracy of such information. You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account.  You agree to immediately notify Company of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security.  Company cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

Pricing.  The prices we charge for using our services and products are listed on tastytalescooking.com. We reserve the right to change our prices for services and products displayed at any time, and to correct pricing errors that may inadvertently occur. 

Payment Terms. If you order a subscription package (with a monthly, 6 months or 13 months term) that auto-renews (“Package”), then you agree to pay the applicable Package price and Taxes upon each auto-renewal date, until you terminate your Subscription.  Your next billing date will be displayed in your My Subscriptions page. Please also note that if your Package includes a discounted Package price for a promotional period, once the promotional period expires, your subscription will renew at the full Package price.  As such, if you purchase a Package, until such time as you terminate your Package in accordance with the directions on this site, you hereby authorize, agree and assent to the Company automatically billing your credit card submitted as part of the order process for such amounts that are due.  You will be solely responsible for payment of all taxes (other than taxes based on Company’s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the Product purchase (“Taxes”) not withheld by Company, including, without limitation, all Product purchased pursuant to any Updated Subscription.  

Subscriptions.  With respect to the automatically-renewed subscriptions to paid Services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Cancellations.  You may cancel automatically-renewed subscriptions at any time by notifying us at info@tastytalescooking.com or by logging into you account, clicking "My Subscriptions", and clicking "Cancel Subscription".

Refunds.  We do not issue refunds for undamaged products or remaining months of a subscribed plan unless we are the ones that terminate a Service.  For any damaged product, please notify us within 14 days of the date you receive the product, and we will replace it or provide a refund based upon the monthly Package value.

THIRD-PARTY OFFERINGS

You may be able to access websites, content, products or services provided by third-parties through links that are made available on tastytalescooking.com.  We refer to all such websites, content, services and products as “Third-Party Offerings.”  For example, we may permit third parties to advertise their products and services on the Site, and those advertisements may contain links to the website(s) of the advertisers.  If you elect to use such Third-Party Offerings, you understand that your use of them will be subject to any terms and conditions required by the applicable third-party provider(s).  You understand that we are not the provider of, and are not responsible for, any such Third-Party Offerings and that these Terms do not themselves grant you any rights to access, use or purchase any Third-Party Offerings.

PROMOTIONAL EMAILS AND TEXT MESSAGING

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

USER  FEEDBACK

If you provide us any feedback or suggestions regarding our Services (“Feedback”), you hereby assign to us all rights in the Feedback and agree that we shall have the right to use such Feedback and related information in any manner it deems appropriate.  Company will treat any Feedback you provide to Company as non-confidential and non-proprietary.  We are and shall be under no obligation to pay compensation for any Feedback or to respond to any Feedback.  You agree that you will not submit to Company any information or ideas that you consider to be confidential or proprietary.

DISCLAIMERS, LIMITATIONS AND EXCLUSIONS OF LIABILITY

Limitation Of Liability

YOU ACKNOWLEDGE THAT THIS LIMITATION OF LIABILITY IS AN ESSENTIAL TERM BETWEEN YOU AND US RELATING TO THE PROVISION OF THE SITE, THE SERVICES AND THE PRODUCTS TO YOU, AND WE WOULD NOT PROVIDE THE SITE OR SERVICE OR PRODUCTS TO YOU WITHOUT THIS LIMITATION.

 

Exclusions

THE LIMITATIONS OR EXCLUSIONS OF WARRANTIES AND REMEDIES CONTAINED IN THESE TERMS SHALL APPLY TO CUSTOMER ONLY TO THE EXTENT SUCH LIMITATIONS OR EXCLUSIONS AND REMEDIES ARE PERMITTED UNDER THE LAWS OF THE JURISDICTION WHERE CUSTOMER IS LOCATED.   CERTAIN STATES AND/OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE EXCLUSIONS SET FORTH ABOVE MAY NOT APPLY TO YOU.

 

Section 8

INDEMNIFICATION

YOU AGREE TO INDEMNIFY, HOLD HARMLESS AND, AT OUR OPTION, DEFEND OUR COMPANY (INCLUDING OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS AND ANY THIRD-PARTY INFORMATION PROVIDERS) FROM AND AGAINST ALL DAMAGES, CLAIMS, DEMANDS, LIABILITIES, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES, RESULTING FROM OR CONNECTION WITH YOUR USE OF OUR SITE OR SERVICES.

TERM AND TERMINATION

We reserve the right to terminate these Terms, your Account, and your access to the Site and the Service at any time without notice.  You may delete your Account at any time, for any reason, by following the instructions on the Site.  If we have suspended or terminated these Terms, your Account, the site, or the Services other than for your breach of these Terms, we will refund you a pro-rata share of any amounts you have pre-paid for a subscription to the Services (if any).  You understand that any termination of your Account involves deletion of your User Content associated contained in our live databases.  Your rights under these Terms will automatically and immediately terminate if you fail to comply with your promises and obligations stated in these Terms. The agreement to the Obligations, Hold harmless and waiver agreement, and Sections 7 and 8 of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

 

Section 10

MISCELLANEOUS AND ENTIRE AGREEMENT TERMS

You agree to comply with all laws, rules and regulations that apply to your use of the Tasty Tales Cooking Services.  Any delay or failure by us to exercise or enforce any right or provision of these terms will not constitute a waiver of such right or provision. If any provision of these terms is found by a court of competent jurisdiction to be invalid, you agree that the court should endeavor to give effect to the intentions reflected in the invalid provision, and the other provisions of these Terms shall remain in full force and effect.  The section titles in these Terms are for convenience only and have no legal or contractual effect. The word including means including without limitation.  These Terms constitute the entire agreement between you and us with regard to the matters described above.  These Terms, and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without Company’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void.

These Terms of Service shall be governed and construed in accordance with the laws of California. Any dispute regarding or arising out of this Privacy Policy shall be subject to the exclusive jurisdiction of the courts in California.
